Who needs DOT drug testing in Seattle?

DOT vs. non-DOT testing in Washington
Washington legalized recreational cannabis for adults, but that does not change federal DOT rules. The U.S. Department of Transportation has stated that state marijuana laws have no effect on DOT drug testing, and Medical Review Officers will not accept state-authorized recreational or medical use as a reason to verify a positive test as negative (ODAPC recreational marijuana notice). A Seattle CDL driver who tests positive for marijuana on a DOT test has a DOT violation, even though cannabis is legal to buy in Washington.
For non-DOT hiring, Washington employers should also be aware of state rules on pre-employment cannabis testing. Since January 1, 2024, RCW 49.44.240 has generally prohibited employers from rejecting a job applicant because of lawful off-duty cannabis use or a pre-employment test that finds non-psychoactive cannabis metabolites. The law does not override drug testing required by federal law, such as DOT testing, and it exempts certain positions, including jobs that require a federal background check or security clearance and some safety-sensitive jobs that the employer identifies before the person applies. Seattle employers with mixed DOT and non-DOT workforces should keep these programs separate and have their written policies reviewed by an employment attorney.

Timing matters for random and post-accident tests
Two situations leave little room for scheduling around Seattle traffic:
- Random tests: once a driver is notified of a random selection, they must go to the collection site immediately. Plan the test for a time and place the driver can reach right away.

- A current government-issued photo ID, such as a driver's license or CDL
- The employer's name and the reason for the test
- Any instructions or authorization your employer gave you
- A list of prescription medications is useful for your own reference, but you do not need to disclose them to the collector. If the lab reports a non-negative result, the Medical Review Officer (MRO) will contact you to discuss legitimate medical explanations.
